PENDING PERMIT APPLICATIONS

The following permit applications have been submitted to the District for review by District staff and consideration by the District Board of Directors.

  

Once District staff determine an application is administratively complete, the District will schedule and hold a public hearing within 60 days to consider the application.

 

Copies of application materials, related documentation, and the proposed action on the application will be available here and at the District Office at least 10 days prior to the hearing. 


Anyone interested in the application may submit written comments to the District prior to the hearing or may attend the hearing and submit written comments or make oral comments.


Anyone interested in protesting an application as party must submit a written request for a contested case hearing in accordance with District Rules.  A form is available here to request a contested case hearing.

Archangel Catholic School of Austin

  • Application submittal date: October 28, 2024
  • Application status: Deemed administratively complete by District staff on February 20, 2025.
  • Permit hearing: Continued hearing scheduled for Wednesday, May 14, 2025, at 9:30 AM at the District office, 8656 W Hwy 71, Bldg. A, Ste. 224, Austin, TX 78735. The hearing is a continuance of the initial hearing held on April 10, 2025, during which the Board granted the Applicant’s request to postpone the hearing to allow additional time to consider the District General Manager’s recommended action. Copies of posted hearing notices are available below.
  • Application Summary: Archangel Catholic School of Austin requests an operating permit to withdraw up to 9.85 million gallons (30.23 acre-feet) of groundwater annually from a Lower Trinity Aquifer well located at 3000 Barton Creek Blvd., Austin, TX 78735 (Latitude N 30.290714, Longitude W 97.874045). The water would be used to irrigate athletic fields at the same location.

JPD BACKYARD FINANCE, LLC

  • Application submittal date: February 28, 2023
  • Application status: Deemed administratively complete by District staff on January 31, 2024.
  • Permit hearing: Continued hearing scheduled for Wednesday, May 14, 2025, at 9:30 AM at the District office, 8656 W Hwy 71, Bldg. A, Ste. 224, Austin, TX 78735 to reopen the administrative record to consider new evidence submitted by the Applicant. This hearing is a continuation of the initial hearing held on March 20, 2024, during which the Board issued a permit for irrigation use of up to 1,142,452 gallons (3.506 acre-feet) of groundwater annually (combined production from Wells 1 and 2). Copies of posted hearing notices are available below.
  • Application summary: JPD Backyard Finance, LLC requests an operating permit to withdraw up to 3,700,492 gallons (11.36 acre-feet) of groundwater annually from two Lower Trinity Aquifer wells located at 13801 Bee Cave Parkway, Austin, TX 78738 (Well No. 1: Longitude W -97.95356, Latitude N 30.311472; Well No. 2: Longitude W -97.952981, Latitude N 30.312153). Water will be used to supply a site water feature, from which it will be diverted for irrigation at the same location 
  • Application materials: Copies of the permit application, supporting documentation, and the Applicant’s responses to notices of deficiency, are provided below.
  • Proposed action: See "Proposed-Operating-Permit_JPD-Backyard-Finance" below.
  • Board decision: Permit issued with special conditions authorizing an annual withdrawal volume not to exceed 1,142,452 gallons (3.506 acre-feet) for irrigation (combined production from Wells 1 and 2). See "SWTCGCD-Permit-OP-LT-JPD-240320" below.
  • Current status: A contested case hearing was referred to the State Office of Administrative Hearing (SOAH) at the Applicant's request. The contested case is currently in abatement while the District and Applicant pursue settlement negotiations. On February 12, 2025, the Board voted to reopen the administrative record to consider new evidence submitted by the Applicant, which will be the focus of the upcoming hearing.
